What is a Registered Agent?

A registered is an individual designated by the company to receive legal notices, service of process, and other tax documents.  Both corporations and LLCs must have a registered agent.

Who can be the registered agent?

The only requirements to be the registered agent for an LLC or a corporation are:

The individual must be over the age or 18.

The individual must reside or have an office in the state where the LLC or corporation is located.

That’s it!

Can I be my own agent?

Yes, you can! As long as you are over 18 and your address is in the state where your LLC or corporation is formed.

Why do people often pay for registered agent service?

The main reason people pay for a company to act as their registered agent is that they do not know better. Nobody told them that they can be their own agent for free. In fact, most if not all of our competitors will offer “free” registered agent service for the first year if they file your LLC or corporation. After the first year they will automatically charge your credit card anywhere from $150 to $400 to act as your agent. That is a lot of money to maybe forward a couple of articles of mail to you.

No. We do not charge for registered agent service. 99% of our customers are small businesses and do not need to pay an outside company to act as their agents. By default when filing an LLC or corporation we use YOU as the agent. The beauty of using this method is you will never have to pay hundreds of dollars per year for glorified mail forwarding. Most people are happy receiving their own mail and service of process to save a few hundred. Although, if you do need one, we can set you up with a commercial registered agent.

There are certain cases where it is appropriate to have a commercial registered agent represent your business. If your LLC is filed in a state like Delaware, where there is no officer info or business address that is public AND you do not want anyone to be able to find you, it might be wise to have a commercial agent. Or, if you are foreign qualifying your business to do business in another state where you do not yet have an address you will need a commercial agent. The reason for this, is you do not have an address to put the agent at yet. In that case, you may start off with a commercial agent, and once you obtain an office use that address.

In most cases, no. Be your own agent for free. Receive your own mail, accept your own service of process, and get your own tax documentation. If you get something in the mail that you don’t understand, chances are you can quickly Google search it to figure out what it is. If AAAFiling.com did your business formation give us a call. Chances are, we have seen it hundreds of times before and we can set you on the right path. Take the money you save on registered agent services and use it for other more important business expenses.
